    The Student Guardian Visa Subclass 590 permits the visa holder to stay in Australia as the guardian of an international student who is under 18 and studying in the country on a student visa. The duration of the visa is based on the student’s visa duration or until the student turns 18. Therefore, the applicant can come to Australia and provide support and care for the student visa holder or student visa applicant.

    Eligibility Criteria for Subclass 590

    The applicant must meet the following criteria to be eligible for the Student Guardian Visa:

    • The applicant must be the student’s parent, legal guardian, or a relative and above 21 years of age. The applicant must also be supported by a written nomination form from the parent or legal guardian of the student.
    • The candidate must have sufficient finances to support their stay and the student during their time in the country.

    The applicant should arrange accommodation, take care of the general welfare, and provide the required support to the student. In general, these visas are not issued to applicants who have a child under age six. However, the visa holder can get a few exceptions that grant the subclass visa under the following circumstances:

    • If there are some compelling or compassionate reasons to issue the Student Guardian Visa.
    • Granting the visa can benefit the relationship between the Australian government and the government of a different country.

    Any accompanying children should satisfy the same health standards as the applicant and subscribe to appropriate health insurance programs for the length of their stay in the country.

    Children who are aged six years or older can accompany the applicant, provided they make a separate application to secure their own student visa. The applicant must satisfy all the criteria and conditions of the visa as long as they are in the country under the visa stream.

    Why Apply For Student Guardian Visa Subclass 590?

    The subclass 590 is a temporary visa, and the length of the visa is decided based on the course of the student, visa, and age. Importantly, an applicant can be the student guardian for more than one student and choose to study an English Language Intensive Course for Overseas Students (ELICOS) – less than 20 hours per week. The visa holder can also attend short duration training programs that usually last for three months. The visa category allows the applicant to study, but they can’t work.

    The visa holder can travel from Australia and return as many times as they want while their visa is valid. However, the visa holder can only move out with the student visa holder, or alternate arrangements should be made to ensure the student’s welfare. The time spent by the Student Guardian Visa holder outside of Australia doesn’t extend the validity of their visa.

    Other Applicable Conditions of Subclass 590

    If an onshore candidate is applying for this international student guardianship visa, they should have a current substantive temporary visa that should not fall into any of the following visa categories:

    • Domestic worker (Temporary) – Consular or Diplomatic visa subclass 426
    • Temporary Work visa (International Relations) – subclass 403 under the Domestic Worker (Consular or Diplomatic) stream
    • Transit subclass 771 visa
    • Diplomatic visa subclass 995 – only for the primary visa holder. That means a family member of a subclass 995 visa holder can apply for a Student Guardian Visa.
    • Visitor visa subclass 600 that falls under the Approved Destination Status or Sponsored Family stream
    • Substantive temporary visas are generally categorised as any visa type except for a criminal justice visa, bridging visa, or enforcement visa. The visa type allows the holder to stay temporarily in Australia.

    The applicant must get health insurance for the entire period of their visa validity. They can procure it in the home country, in Australia, or by Overseas Visitors Health Cover (OVHC).

    For a 590 subclass visa application, the candidate must meet the Genuine Temporary Entrant Requirement conditions.
